Protecting Illinois’ Daily Fantasy Sports Games and Players

Across the country, daily fantasy sports (DFS) are incredibly popular, and for good reason: they’re simple to learn, fun to play, and a safe option for consumers who want to play along with their favorite athletes.

As DFS gains popularity and innovation in the industry soars, players deserve strong consumer protections. 

Thankfully, State Senator Lakesia Collins and Representative Eva-Dina Delgado have introduced the The Fantasy Sports Consumer Protection Act, which would:

Solidify the legal status of DFS contests in Illinois

Protect consumers by providing guardrails to keep bad actors out of the market

Generate millions in new  tax revenue for the state of Illinois

Codify responsible gaming measures and ensure additional consumer protections

Boosting IL’s Tax Revenue

With the passage of this bill, it is estimated that DFS operators alone will generate upwards of $136 million in NEW tax revenue for the State of Illinois over the next 12 years.

Bottom line: the more games the State licenses, the more money that’s available to fund critical programs such as education, healthcare and infrastructure.

Why Daily Fantasy Sports, Why Now?

DFS are currently legal in Illinois — this was confirmed by the Illinois State Supreme Court in 2020. But without fuller regulations, players may not be fully protected from bad actors in the space, and could potentially lose access to these games virtually overnight.

The Fantasy Sports Consumer Protection Act (SB3710/HB5648)

Passing the Fantasy Sports Consumer Protection Act (“FSCPA”) to affirm the legal status of DFS in Illinois will protect the interests of players of these increasingly popular contests. The FSCPA will provide guardrails to keep bad actors out of the market, codify responsible gaming measures and ensure additional consumer protections. 

Furthermore, in supporting the Fantasy Consumer Protection Act, legislators in Illinois have the opportunity to confirm the legal status of DFS in Illinois, and in doing so ensure that DFS contests can bring in new tax revenue for Illinois.

We urge members of the Illinois House and Senate to join lead legislative sponsors Representative Eva-Dina Delgado and Senator Lakesia Collins to ensure the Fantasy Consumer Protection Act enshrines these changes in Illinois law.
